
You can ask. Whether it is possible depends on issues that sit outside your hiring manager's control - so the way you raise it matters as much as the request itself.
Why UK employers hesitate
Employment law and payroll. Employing someone resident in India means Indian employment law, Indian payroll and, potentially, a permanent establishment risk for the company's tax position. Most UK employers are not set up for this.
Immigration. If the offer was made on the basis of sponsorship, working remotely from India instead is not a variation of the same arrangement - it is a different thing entirely, and it usually ends the sponsorship.
Team and client expectations. Some roles have security, on-site or regulatory constraints that make remote work from outside the UK impossible regardless of goodwill.
The three outcomes you might get
- Contractor arrangement. You invoice from India as a service provider. Simple for them, but you lose employment protections, benefits and, crucially, the visa route.
- Employer of record. The company engages a third party who employs you locally. Increasingly common, but it costs the employer more and only larger organisations tend to bother.
- No. Which, if sponsorship was the point of the offer, is the answer that protects your route.
How to raise it without damaging the offer
- Never at the offer stage as a condition. Accept or decline on the terms offered; raise flexibility separately.
- Ask about the problem, not the perk. "Is there a period before my visa is issued where I could start remotely?" is answerable. "Can I stay in India?" often is not.
- Offer to solve their side. If you know of an employer-of-record option, naming it shows you have thought about their exposure.
- Be clear about your goal. If your real aim is to move to the UK, do not negotiate yourself out of the visa.
The strategic point
